These conditions are and must be accepted by the parties to proceed with the purchase.

PREMISE

These general conditions of sale are valid exclusively between the company ESSENTIAL NAIL SYSTEM ITALIA SRLS with registered office in Rende (Cs) Via Gino Bartali 1 Cap 87036 Fraction: Contrada Coda Di Volpe, VAT number 03661120786, and Logistics Naples operational headquarters, SS7bis Giugliano in Campania, Cap. 80014 hereinafter referred to as "Eclissi nail system" and any individual who makes an online purchase on the website www.eclissinailsystem.it hereinafter referred to as "CUSTOMER" in accordance with the provisions of Italian law of Part III, Title III , Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and by Legislative Decree 70/2003 on electronic commerce.

Eclissinailsystem.it sells and the CUSTOMER remotely purchases the products indicated on the website www.eclissinailsystem.it. The contract is concluded remotely and exclusively through the internet, by accessing the CUSTOMER at www.eclissinailsystem.it and with the creation of an
online purchase order.

In the event of subsequent changes to the general conditions of sale, the date of publication of the same on the site should be considered as the date of entry into force.

The language available to conclude the contract is Italian.

As governed by art. 12 of Legislative Decree no. 70/2003 the CUSTOMER before proceeding to confirm his order is required to carefully read the general conditions of sale and the precontractual information (POINT 1.) available on the website www.eclissinailsystem.it. Once the order has been placed, the CUSTOMER will receive an e-mail confirming the order, which will contain a link to download and archive a copy of these general conditions of sale, as required by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.

2. Orders, Order Confirmation And Product Availability Orders

To purchase the Products, the CUSTOMER must simply insert the Product in the appropriate "CART", read the General Conditions of Sale, the shipping costs, the legislation on the right of withdrawal and the Privacy Policy. The purchase will be considered concluded after selecting the desired payment method and choosing the "CONFIRM MY ORDER" option. Using a PayPal account, on the other hand, the payment will be considered finalized once the "Pay with PAYPAL account" option has been chosen. 2.1 Confirmation of receipt of the order and effectiveness of the contract

The e-mail contains the CUSTOMER data; the order number; the price of individual products; the total amount to be paid for the goods; shipping costs; the necessary information with address and order code to submit any complaints and request assistance services.

The CUSTOMER undertakes to verify the correctness of the personal data contained therein and to promptly communicate any corrections to eclissinailsystem.it.

The CUSTOMER will have the opportunity to view and follow the status of his order through the "ORDER HISTORY AND DETAILS" area of his account.

Eclissinailsystem.it reserves the right to evaluate the acceptance of orders received. Eclissinailsystem.it will notify the CUSTOMER if it is impossible to accept the order received within 5 days from the day following the day in which the Customer sent the order to eclissinailsystem.it and will refund any sums already paid by the Customer for payment of the supply within 14 days.

If eclissinailsystem.it has reasonable grounds to believe that the CUSTOMER does not operate on the basis of an effective and genuine interest in purchasing the products, or abuses the right of withdrawal (in point 6) the order forwarded by the CUSTOMER will be considered ineffective. In this last case, Eclissinailsystem.it will send the CUSTOMER via e-mail, a communication certifying the non-conclusion of the contract, taking care of the cancellation of any charge to be paid by the CUSTOMER.

2.2 Product Availability

The products indicated on the site as available may subsequently be out of stock. Even after sending the order confirmation e-mail sent by Eclissinailsystem.it, there may be cases of partial or total absence of the goods. This happens because the availability of the products is to be considered only approximate. It could happen that due to the effect of the presence on the site of multiple users, the products initially available may have already been sold to other CUSTOMERS even after the order has been confirmed. In this case, the order will be automatically corrected with the elimination of the unavailable product and the CUSTOMER will be informed by e-mail from Eclissinailsystem.it.

In the event that the CUSTOMER requests the cancellation of the order, eclissinailsystem.it will refund the amount paid within 14 days from the day on which eclissinailsystem.it became aware of the customer's decision to cancel the contract.

3. Products

Eclissinailsystem.it undertakes to describe and present the items sold on the site in the best possible way. The photographs of the products presented on eclissinailsystem.it do not constitute a contractual element, as they are only representative. In the event that some errors, inaccuracies or small differences between the site and the actual product are highlighted, Eclissinailsystem.it reserves the right to be able to correct such errors, inaccuracies and omissions at any time with / without prior notice. 4. Price policy in Italy

The sales prices of the products indicated on the website www.eclissinailsystem.it are indicated in euros (€) and include VAT and all taxes and duties. Shipping costs are not included in the purchase price, but are entered and calculated at the conclusion of the purchase process.

The CUSTOMER accepts the right of Eclissinailsystem.it to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time the order is created and indicated in the confirmation e-mail sent by ECLISSINAILSYSTEM. IT to the CUSTOMER.

5. Methods of Payment in Italy

The CUSTOMER undertakes to pay the price of the products and the delivery costs, by bank transfer, by PayPal payment method or at the time of delivery by paying in cash by cash on delivery.

Eclissinailsystem.it accepts payments made by advance bank transfer. The transfer must be made payable to Essential Nail System Italia S.r.l.s. at BCC CREDITO COOPERATIVO MEDIOCRATI, RENDE branch VIA ALFIERI RENDE 87036 (CS), IBAN IT02M0706280880000000137901 and the order number must be indicated in the reason for payment. The transfer must be made within 5 working days from the order, after this deadline the unpaid order will be considered invalid and therefore canceled. Any bank charges will be charged to the CUSTOMER. In the event that, for any reason, the debit of the amounts due by the CUSTOMER proves impossible, the purchase order is automatically canceled.

Eclissinailsystem.it accepts payments made with PayPal. In the case of payment via PayPal account, the actual order will be charged when eclissinailsystem.it sends the order confirmation e-mail.

Eclissinailsystem.it accepts cash payment made by "cash on delivery" by courier upon delivery. Upon delivery of the shipment, the CUSTOMER must pay the amount of the order in cash to the courier responsible for the delivery of the goods. The order amount will be increased by 1% on purchases over € 200. For smaller orders, the surcharge is 2 € cash on delivery. In the event that the package is refused by the Customer, the costs of storage and for the return of the goods will be borne by him.

6. Right of withdrawal valid only in Italy

6.1 Effects of Withdrawal 

If the Customer withdraws from this contract, all payments made to us will be reimbursed, including delivery costs (with the exception of additional costs arising from your choice of a type of delivery other than the least expensive type of standard delivery to be offered us), without undue delay and in any case no later than 14 days from the day on which we were informed of your decision to withdraw from this contract.

These refunds will be made using the same payment method used by the Customer for the initial transaction, unless the Customer has expressly agreed otherwise; in any case, it will not have to incur any costs as a consequence of this reimbursement.

If, on the other hand, the Customer has made a cash on delivery payment, the refund of the amount to be returned will be made by bank transfer, therefore the Customer must promptly communicate their bank IBAN where to credit the refund amount. This is not an essential condition for the valid exercise of the right of withdrawal by the customer, but it will help us to make the refund process easier and faster.

The refund may be suspended until receipt of the goods or until the consumer has demonstrated that he has returned the goods, whichever is earlier.

The products purchased by the CUSTOMER will be delivered from Monday to Friday, excluding holidays and national holidays, by courier to the address indicated at the time of the order within 24h - 48h from the date of receipt by the CUSTOMER of the e-mail confirming the order sent by eclissinailsystem.it

Eclissinailsystem.it does not deliver to post office boxes, to minors and is not responsible for unforeseeable delays. The CUSTOMER may request the delivery of the goods to a person in charge at the address of the recipient indicated in the order.

Once the Products have been shipped, Eclissinailsystem.it will send the CUSTOMER a confirmation e-mail with the shipment tracking number to view the status of the shipment. The Customer is required to check that the number of packages delivered by the courier corresponds to what is indicated in the transport document and that the package is intact or not altered. Any disputes regarding the number of packages, damage to packages or products must be immediately challenged by means of a written control reserve on the courier's proof of delivery. 8. Product Replacement And Goods Conformity Defects

8.1 Product replacement

For perishable materials it is possible to make any replacements no later than 15 days from purchase. The shipping costs related to the return of the Product are charged to the Customer. 8.2 Defects of conformity of the goods

In the event that following a purchase on the website www.eclissinailsystem.it, the CUSTOMER receives Products that do not comply with the orders or are defective, as required by the legalguarantees provided for in articles 129, 130 and 132 of the Consumer Code, he can exercise the restoration of the conformity of the goods by repair, replacement, an appropriate reduction in the price or termination of the contract.

Europe 1: € 18.90 from 0 to 1 Kg; € 23.90 from 1.1 to 5 Kg; € 28.90 from 5.1 to 10 kg and so on up to 30 kg, always increasing by € 5 compared to the previous range

The products purchased by the CUSTOMER will be delivered in 48 hours to the European economic centers: Germany, France, Austria, Spain, Belgium, Holland, Luxembourg; delivery in 72/96 hours in the most distant European countries, excluding holidays and national holidays, by courier to the address indicated at the time of the order.
